Reinstating two deputy heads of regional customs office of the State Fiscal Service of Ukraine, who were unlawfully dismissed in 2015 under the Law of Ukraine on Purification of Government

The Onopenko & Partners team defended violated rights and interests of public officers in a dispute with the State Customs Service of Ukraine over the reinstatement and recovery of average salary for the entire time of the forced leave of absence from 2015 to 2021.

The attorneys from Onopenko & Partners successfully appealed against the unlawful decisions for dismissal of two deputy heads of regional customs office of the State Fiscal Service of Ukraine and consequently prevailed in the administrative case in courts of all instances: trial court, court of appeal and court of cassation.

In view that the lawyers from Onopenko & Partners prevailed in the case, the State Customs Service of Ukraine had to issue long-awaited orders to reinstate the customs officers previously lustrated and to pay them more than UAH 2 mln as a compensation for the entire time of the forced leave of absence.

The Administrative Court of Cassation within the Supreme Court found, upon rendering its final ruling, that the dismissal under the Law of Ukraine on Purification of Government (Lustration) in 2015 involved a number of violations of the rights, freedoms and interests set forth in the Constitution of Ukraine and the Convention for the Protection of Human Rights and Fundamental Freedoms.
